Emergency and Proposed Amended Rules

Emergency Rules - Effective Date August 18, 2019

On August 8, 2019, the Commission filed two emergency amendments to Commission rules related to registration and reporting by Federal Political Action Committees contributing to candidates for the Missouri General Assembly. These rules are consistent with Article III, Section 2(f) of the Missouri Constitution, passed by the voters, that prohibits candidates for the General Assembly from accepting contributions from any federal political action committee unless the committee files disclosure reports with the Missouri Ethics Commission.

Proposed Rules

On August 8, 2019, the Commission also filed four proposed rules. Two proposed amendments mirror the emergency rules above.

Two of the Commission’s proposed amendments relate to hearing procedures before the Commission.

  • 1 CSR 50-2.040 Prehearing Conferences – This rule was amended to require the request for a prehearing conference to contain the purpose for the request and to include the requirement that the purpose be consistent with the purposes in 1 CSR 50-2.040(4). Additionally, the rule was amended to implement a deadline for requesting a prehearing conference: seven (7) days prior to a scheduled hearing.
  • 1 CSR 50-2.070 Continuances – This rule was amended to implement a requirement that requests for continuances should be filed no later seven (7) days prior to a scheduled hearing. Additionally, the rule was amended to include a requirement that requests for a hearing continuance that are filed later than seven (7) days prior to a scheduled hearing should also include an explanation providing a good cause basis for the untimeliness of the request. Finally, this proposed amendment will allow either the full Commission or specially appointed presiding Commissioner to rule upon such requests.

The emergency rules and the proposed rules have been published in the September 16, 2019 edition of the Missouri Register, with a comment period ending October 16, 2019.
